Select Board enters executive session on CarMax litigation and prior minutes

WESTBOROUGH — Select Board enters closed session over CarMax litigation. Vice Chair Mark Silverberg called the meeting to order remotely and the board unanimously approved a motion by Member Patrick Welch to enter executive session under Massachusetts General Law Chapter 30A for litigation strategy discussions in CarMax Auto Superstores, Inc. v. Town of Westborough (Worcester Superior Court Case No. 2585CV013810) and docket No. 23WEM02137.

Vice Chair Silverberg declared an open meeting would harm the town's litigating position. The motion also approved prior executive session minutes from April 14 and May 4, 2026. The board did not return to open session.
